The Premier League could still find itself in a difficult position, even if it successfully appeals the recent decision in Leicester City’s profit and sustainability (PSR) case.
Finance expert Stefan Borson explained to Football Insider that the league may have to impose a points deduction on Leicester, effectively discrediting its own appeal board if the ruling is overturned.
Leicester was charged in March for breaching PSR rules for the 2022-23 season after reporting losses of £89.7 million, while clubs are allowed to lose a maximum of £105 million over three years. Leicester contended that they were no longer a Premier League club when they submitted their accounts on June 30, following their relegation to the Championship.
An independent commission rejected these claims in July, ruling that the Premier League could proceed with charges against the club. However, Leicester announced on September 3 that their appeal had been successful, giving them a crucial advantage in avoiding a points deduction.
According to a report from The Lawyer on October 16, the Premier League is preparing to appeal this decision. Borson noted that the league likely anticipated this outcome.
“The Premier League may disagree with the ruling, but the stakes are higher,” he said. “They need to prove that no reasonable panel would have supported the appeal board’s decision, which seems improbable.”
Borson emphasized that even if the Premier League wins the appeal, it would result in a loss for them. “Winning would mean prosecuting Leicester and imposing a points deduction, which would undermine their own appeal board,” he stated. “This would suggest that the appeal board was so flawed that it reached an unreasonable conclusion, calling into question the integrity of the Premier League’s processes and its judicial panel.”
